										<content:encoded><![CDATA[<p><strong>Washington, DC</strong> — Today, on the 100th anniversary of Nelson Mandela’s birth, Property of the People is making all documents about Mandela obtained through it&#8217;s FOIA litigation from the FBI, CIA, DIA, and NSA available to the public.  Spanning thousands of pages, the vast majority of these documents have never before been seen by the public.</p>
<h3>Searchable Archive of Documents <a href="https://propertyofthepeople.org/documentcloud-data/?id=37831">Published Online Today</a> **</h3>
<p>For his role coordinating the movement to end apartheid in South Africa, Nelson Mandela was arrested in 1962, ultimately serving 27 years in prison. Though Mandela was freed in 1990, Mandela remained on the U.S. <a href="https://www.nbcnews.com/news/world/us-government-considered-nelson-mandela-terrorist-until-2008-flna2D11708787">terror watchlist</a> until 2008. Despite long standing public knowledge of U.S. intelligence agency <a href="https://www.nytimes.com/1986/10/13/opinion/a-loophole-in-us-sanctions-against-pretoria.html?smid=tw-share">assistance</a> to apartheid South Africa, and <a href="http://icm-tracking.meltwater.com/link.php?DynEngagement=true&amp;H=I%2BqMhXDuIS2RujNbavWSOKShOr7Ezi73JeGvxlkJ09Qb0kDpZZQFeAisbdqCzX9taLGEpjHI2wLYRWmWyr61bZsS2AK05Q1T3FhFp4mnZv0rJwq%2BMGBGXxI4wZ%2Fj394R&amp;G=0&amp;R=https%3A%2F%2Fwww.theguardian.com%2Fus-news%2F2016%2Fmay%2F15%2Fcia-operative-nelson-mandela-1962-arrest&amp;I=20180718161838.000000092a5e%40mail6-46-ussnn1&amp;X=MHwxMDQ2NzU4OjViNGY2NGExNTg5ZGQ3MGEwMmVmNDY5YTs%3D&amp;S=QcBc8OnDEKjipeImqCcrEIGhQf3q_GNSplz4dC84Jhk">likely involvement</a> in Mandela’s 1962 arrest in particular, little specific public information exists on these crucial matters.</p>
<p>Shortly after Nelson Mandela’s death in 2013, MIT PhD candidate and <a href="https://propertyofthepeople.org">Property of the People</a> president, Ryan Shapiro, <a href="https://www.sparrowmedia.net/2014/03/nsa-national-defense-espionage-act-mit-foia-nelson-mandela/">filed</a> a Freedom of Information Act (FOIA) <a href="https://www.democracynow.org/2014/3/25/exclusive_nsa_fbi_dia_sued_over">lawsuit</a> against the Central Intelligence Agency (CIA), the Federal Bureau of Investigation (FBI), the National Security Agency (NSA), and the Defense Intelligence Agency (DIA) for records on agency efforts to counter Mandela and his movement for racial justice in South Africa.</p>
<p>Shapiro’s FOIA lawsuit, which remains ongoing, has forced the intelligence agencies to release thousands of pages of illuminating documents. Shapiro has made a portion of these documents available to the public, resulting in <a href="https://www.theguardian.com/world/2014/jul/10/fbi-monitored-mandela-1990s-communist-threat">extensive</a> press <a href="https://www.usnews.com/news/articles/2014/07/10/the-fbi-spied-on-nelson-mandela-in-1990-as-communist-threat">coverage</a> of FBI efforts to surveil and subvert Nelson Mandela and his struggle for racial justice. Some highlights of these documents are provided below.</p>
<h3>According to Shapiro</h3>
<h4><strong>Regarding the released FBI documents specifically:</strong></h4>
<p>“These documents not only bring to light politically motivated FBI spying on Mandela, they also expose something even darker. The documents reveal that, just as it did in the 1950s and 60s with Martin Luther King Jr. and the civil rights movement, the FBI aggressively investigated the U.S. and South African anti-apartheid movements as Communist plots imperiling American security. Worse still, the documents demonstrate the FBI continued its wrong-headed Communist menace investigations of Mandela and the anti-apartheid movement even after U.S. imposition of trade sanctions against apartheid South Africa, after Mandela’s globally-celebrated release from prison, and after the fall of the Berlin Wall. Ultimately, what the documents reveal is the FBI’s unflagging conflation of social justice efforts with security threats, and the FBI’s cartoonish obsession with Communist Party subversion in the United States even as the Cold War itself crumbled into obsolescence.”</p>
<h4><strong>Regarding the released documents more broadly:</strong></h4>
<p>“Democracy cannot meaningfully exist without an informed citizenry, and such a citizenry is impossible without broad public access to information about the operations of government. Secrecy is a cancer on the body of democracy. The records of government are the property of the people. Yet, unknown billions of pages are needlessly hidden from the people behind closed doors and “classified” markings. It is an honor to make public for all these critical documents about the United States’ long and continuing conflation of necessary social justice efforts with threats to American security.”</p>

<div class=""><span class="">Winner has been charged under the Espionage Act, a 100-year-old statute originally designed for spies and saboteurs, for allegedly giving a document vital to the public’s understanding of potential Russian interference in U.S. election systems to a news organization.</span></div>

<div class=""><span class="">Stand With Reality believes the charge against Winner is grossly disproportionate to her alleged offense, and is designed to create a chilling effect on investigative journalism by dissuading sources from sharing information that is critical to the public interest. The group is dedicated to raising public awareness of Winner’s case, as well as the U.S. government’s persistent abuse of the Espionage Act to silence its critics and stifle journalism. </span></div>

<div class=""><span class="">“The document Winner is alleged to have given</span><span class=""> The Intercept</span><span class=""> is vital for understanding how U.S. election systems are seriously vulnerable to hacking. It is absurd that the government is charging her under the draconian Espionage Act rather than helping states fix our country’s election security,” said Jeff Paterson, Courage to Resist project director and co-founder of Stand With Reality.</span></div>

<div class=""><span class="">The organization aims to fully fund Winner’s legal defense team headed by attorney Titus Nichols, of the Augusta, Georgia law firm of Bell &amp; Brigham. Stand with Reality launched a crowdfunding campaign today to cover both legal fees and public awareness efforts. &#8220;It is refreshing to know that so many people that Ms. Winner has never known have come together to offer their support and prayers for her,” notes Nichols. “Your pledge of additional support, for fees related to her case, is commendable,” he adds.</span></div>

<div class=""><span class="">“The new Stand with Reality group means the world to me. Not only are they going to be raising money for my daughter’s legal defense, they&#8217;ll also be raising awareness. Reality won&#8217;t be forgotten, and she&#8217;ll have a whole organization behind her,” said Winner’s mother, Billie Winner-Davis, of Kingsville, Texas. The Winner Family will be closing their GoFundMe effort and directing supporters to the new Reality Winner Defense Fund hosted by Courage to Resist in collaboration with Stand with Reality. Meanwhile, the UK-based Courage Foundation is undertaking fundraising and support efforts on behalf of Winner throughout Europe.</span></div>

<div class=""><span class="">First Look Media’s </span><a class="" href="https://www.firstlook.media/freedom-of-press-defense-fund"><span class="">Press Freedom Defense Fund</span></a><span class=""> provided a grant of $50,000 which will act as a matching fund for the first $50,000 raised for this campaign between now and August 30th. First Look is the publisher of </span><span class="">The Intercept</span><span class="">, which published its story based on a document allegedly provided by Winner after receiving it anonymously. The Fund is committed to supporting legal fights where key principles of press freedom are at stake, including the defense of journalistic sources like Winner facing this Espionage Act charge.</span></div>

<div class=""><span class="">Winner, 25, is an Air Force veteran and recipient of the Air Force Commendation Medal for those who have &#8220;distinguished themselves by meritorious achievement and service.&#8221; She is universally described by friends and family as a “patriot”.</span></div>

<div class=""><span class="">She is currently being denied bail on the basis that she is a flight risk, despite assurances from her family, and their offer of their 20-acre Southern Texas ranch as collateral.</span></div>

<div class=""><span class="">“We believe the prosecution is trying to demoralize Reality and her family by denying her bail,” said Rainey Reitman, open Internet advocate and co-founder of Stand with Reality. “They’re punishing her with months in jail, and denying her the opportunity to fully participate in her defense preparations, all before a jury hears the merits of the government’s case.”</span></div>

										<content:encoded><![CDATA[<p dir="ltr"><span style="font-family: tiempos-headline;">Washington, DC </span>—  Today, as a result of ongoing FOIA litigation, the US Department of State and Department of Homeland Security released four (4) documents to the newly formed transparency project <a href="https://www.operationfortyfive.org/">Operation 45</a>.  Among the documents released Friday afternoon were records responsive to <a href="https://www.sparrowmedia.net/wp-content/uploads/2017/06/16-2517-CKK_2017.06.23_State-Production-1.pdf">a November 1, 2016 letter</a> from Senators Dianne Feinstein and Benjamin Cardin wherein the Senators call on then President Barack Obama to take immediate action against Russia for intrusions into the 2016 election, which was at the moment of their letter just over a week away.</p>
<p dir="ltr"><span id="more-9575"></span>As investigative journalist Jason Leopold, a co-plaintiff in the suit, <a href="https://www.buzzfeed.com/jasonleopold/in-days-before-election-democratic-lawmakers-urged-obama-to?utm_term=.yra0mY4AA#.efzzG9RKK">reported for <span style="font-family: tiempos-text-italic;">Buzzfeed</span>,</a> the letter “stands as a missing piece to a timeline about Democratic eufforts to encourage the White House to speak out about Russia’s intrusion sooner.”</p>
<p dir="ltr">Included in the released documents are <a href="https://www.sparrowmedia.net/wp-content/uploads/2017/06/16-2517-CKK_2017.06.23_State-Production-1.pdf">responses from Julia Frifield</a>, Assistant Secretary of State for Legislative Affairs at the State Department stating that they, &#8220;will not tolerate attempts to interfere with the U.S. Democratic process, and we will take action to protect our interests, including in cyberspace, and we will do so at a time and place of our choosing.&#8221;</p>

<p dir="ltr">Also included in the documents released is a partially redacted 28-page Homeland Security newsletter on cybersecurity situational awareness titled, <em><a href="https://www.sparrowmedia.net/wp-content/uploads/2017/06/16-2517-CKK_2017.06.23_DHS-Production-1.pdf">The WASP</a></em>.</p>
<p dir="ltr">In November 2016, investigative journalist Jason Leopold and Massachusetts Institute of Technology (MIT) PhD candidate/Harvard Klein Center for Internet &amp; Society research affiliate, Ryan Shapiro submitted FOIA requests to the CIA, FBI, DHS, and ODNI for records pertaining to Russian interference in the 2016 U.S. presidential election, as well as records pertaining to U.S. intelligence agency operations involving any such Russian interference.</p>
<p dir="ltr">After the agencies failed to respond to their request, Shapiro and Leopold filed <a href="https://www.sparrowmedia.net/wp-content/uploads/2016/12/Complaint-PACER-1.pdf">a lawsuit</a> on December 26, 2016.  The following documents are the first production of responsive documents since the suit was filed.</p>

<p>On August 18, 2016, Shapiro and Leopold submitted a FOIA request to the FBI seeking “disclosure of any and all records, including investigative records, mentioning or referring to Donald J. Trump’s statement on 27 July, 2016 [regarding Secretary Hillary Clinton&#8217;s State Department emails], ‘Russia, if you’re listening, I hope you’re able to find the 30,000 emails that are missing,’ and ‘I think you will probably be rewarded mightily by our press.’”</p>
<p>When the FBI did not respond in a timely manner to the FOIA request, Shapiro and Leopold sued. During the lawsuit, the FBI initially asserted that it could neither confirm nor deny the existence of documents responsive to this FOIA request.</p>

Trump</em>, <em>not his advisors, surrogates, or campaign staff.</em></p>

<p>In a court filing in this case on April 6, 2017, a Justice Department attorney representing the FBI informed the Court that there is an “active, ongoing investigation” pertaining to this matter and claimed that disclosing the “records that are responsive to the Russia Request” could reasonably be expected to interfere with “enforcement proceedings.” (As noted elsewhere in the DOJ/FBI’s new filing, the term “Russia Request” refers explicitly to Shapiro and Leopold’s FOIA request quoted above.) The DOJ/FBI’s new court filing acknowledges the existence of records responsive to Shapiro and Leopold’s “Russia Request”, and claimed that all, or virtually all, of these documents cannot be released because of the potential to interfere with active law enforcement proceedings.</p>

										<content:encoded><![CDATA[<p><span style="font-family: tiempos-headline;">WASHINGTON, DC</span> — Multiple federal agencies are in violation of the Freedom of Information Act. Investigative journalist Jason Leopold and Massachusetts Institute of Technology (MIT) PhD candidate/Harvard Klein Center for Internet &amp; Society research affiliate, Ryan Shapiro, <a href="https://www.sparrowmedia.net/wp-content/uploads/2017/01/Complaint-PACER.pdf">filed a lawsuit</a> this morning against the Department of Justice (DOJ), Department of State (DOS), Department of Homeland Security (DHS), the Department of Defense (DOD), the Securities and Exchange Commission (SEC), the Equal Opportunity Employment Commission (EEOC), the Environmental Protection Agency (EPA), and the National Security Agency (NSA). The suit is over the agencies’ failure to comply with Shapiro and Leopold’s Freedom of Information Act (FOIA) request for records on President Trump’s nominee for Attorney General, Jeff Sessions.</p>
<p>Shapiro and Leopold submitted FOIA requests to the DOJ, DOS, DHS, DOD, SEC, EEOC, EPA, and NSA for records pertaining to President Trump’s nominee for Attorney General, Jeff Sessions.</p>
<p>Jeff Sessions’ nomination for Attorney General is one of the most controversial in American history. Sessions has an <a href="https://newrepublic.com/article/61363/closed-sessions">extensive track record of opposition to civil rights</a> and civil rights activists, and has decried the Voting Rights Act of 1965 as a <a href="https://www.thenation.com/article/jeff-sessions-trumps-pick-for-attorney-general-is-a-fierce-opponent-of-civil-rights/">“piece of intrusive legislation.”</a> Hounded for decades by allegations of deep-rooted racism, Sessions was rejected for a federal judgeship in 1986 by the Senate Judiciary Committee partially on the sworn statement of a DOJ attorney who testified that Sessions <a href="http://www.thedailybeast.com/articles/2017/01/09/jeff-sessions-wanted-to-drop-the-case-against-kkk-lynching-attorney-testified.html">spoke favorably of the Ku Klux Klan</a> and decried the NAACP and ACLU as <a href="https://www.washingtonpost.com/news/the-fix/wp/2016/11/18/that-time-the-senate-denied-jeff-sessions-a-federal-judgeship-over-accusations-of-racism/?utm_term=.4e0fb4e7e1da">“un-American” and “Communist-inspired”</a> organizations. Further, the Republicans are forcing President Trump’s nominees through the confirmation process with only the most limited and superficial of hearings.</p>
<p>The records Shapiro and Leopold have sued over today will help shed light on the often obscured detailed of Sessions’ history as a state and federal Attorney General and as lawmaker.</p>

<p style="padding-left: 30px;"><span style="font-family: gt-cinetype-mono; font-size: 12pt;">* Records pertaining to the conservative political action committee (PAC) Judicial Crisis Network, which is dedicated to securing confirmation of Sessions as Attorney General.</span></p>
<p style="padding-left: 30px;"><span style="font-family: gt-cinetype-mono; font-size: 12pt;">* Records pertaining to <a href="http://confirmsession.com/">confirmsession.com</a>, a website and project of Judicial Crisis Network dedicated to securing confirmation of Sessions as Attorney General.</span></p>
<p><strong>2.)</strong> Due to the urgency of the matter, Shapiro and Leopold requested expedited processing of their FOIA requests. The DOJ, DOS, DHS, DOD, SEC, EEOC, EPA, and NSA failed to respond. This is a violation of the Freedom of Information Act.</p>
<p><strong>3.)</strong> Not including this new lawsuit, Shapiro and Leopold already have four FOIA lawsuits against the FBI and other federal agencies for records on investigations involving Donald Trump.</p>
<p class="p1">In the <a href="https://news.vice.com/article/secret-service-added-lawsuit-seeking-records-on-donald-trump">first</a> of these lawsuits, among other things, Operation 45 is suing the FBI and Secret Service for records on Donald Trump’s thinly-veiled assassination remarks regarding Hillary Clinton, and his less than veiled campaign trail call for Russian hacking of Hillary Clinton’s emails. The FBI unlawfully failed to respond to Shapiro and Leopold’s FOIA request, and then slow-walked an initial response to Shapiro and Leopold’s lawsuit until after the election.</p>
<p class="p1">Notably, the FBI’s response indicates the FBI <a href="https://news.vice.com/story/fbi-may-have-been-investigating-trump-when-comey-announced-new-clinton-emails">might indeed be investigating Donald Trump</a> for these incidents. However, in stark contrast to Director Comey’s pre-election rush to inform Congress that the FBI might re-open its investigation of Hillary Clinton, in this case the FBI dragged its feet to avoid revealing the same about Donald Trump until after the election.</p>

Investigative journalist Jason Leopold and Massachusetts Institute of Technology (MIT) PhD candidate/Harvard Klein Center for Internet &amp; Society research affiliate, Ryan Shapiro, <a href="http://www.sparrowmedia.net/wp-content/uploads/2016/12/Complaint-PACER.pdf">filed a lawsuit</a> this morning against the Federal Bureau of Investigation. The suit is over the FBI’s failure to comply with Shapiro and Leopold’s Freedom of Information Act (FOIA) request for records on the FBI’s role in the 2016 U.S. presidential election.</p>
<p>Jason Leopold is an award-winning Senior Investigative Reporter at <em>Vice News</em>, specializing in counterterrorism and human rights. Leopold has been called a “FOIA Terrorist” by federal employees for his aggressive use of the Freedom of Information Act, which includes successfully <a href="http://truth-out.org/news/item/10400-a-victory-in-my-foia-lawsuit-against-the-fbi">suing</a> the FBI to force changes to Bureau FOIA practices.</p>
<p>Ryan Shapiro, referred to by <em>Politico</em> as “a <a href="http://www.politico.com/tipsheets/morning-agriculture/2016/08/hampton-creek-just-mayo-scandal-spreads-a-well-worn-path-for-gmo-labeling-enforcement-cattlemen-test-esa-voluntary-conservation-push-215731">FOIA guru</a> at the Massachusetts Institute of Technology&#8221;, is an historian of national security, the policing of dissent, and governmental transparency. Shapiro’s pathbreaking FOIA work has already led the FBI to declare his MIT dissertation research <a href="http://www.motherjones.com/politics/2013/11/foia-ryan-shapiro-fbi-files-lawsuit">a threat to national security</a>. Shapiro is a Ph.D. candidate in the Department of Science, Technology, and Society (HASTS) at MIT, as well as a Research Affiliate at the Berkman Klein Center for Internet &amp; Society at Harvard University.</p>

<p><span style="font-family: gt-cinetype-mono;">2.)</span> Even as J. Edgar Hoover and his FBI coordinated much of the red-baiting of the McCarthy era, the Bureau staunchly maintained it was a purely apolitical entity. Current FBI Director James Comey also insists, notwithstanding the FBI’s previous transgressions, today’s Bureau truly is outside and above politics. However, numerous leading political and news media figures from across the political spectrum explicitly assert the FBI repeatedly and with significant impact affected the outcome of the 2016 U.S. Presidential election. For example, both Senate Minority leader <a href="http://www.cnn.com/2016/12/12/politics/harry-reid-james-comey-election/">Harry Reid</a> and former Donald Trump campaign manager <a href="http://www.huffingtonpost.com/entry/corey-lewandowski-james-comey_us_582dd4f7e4b058ce7aa97d7c">Corey Lewandowski</a> openly credit Director Comey and his FBI for Donald Trump’s electoral victory over Hillary Clinton. Even prior to the election, in late October, a piece in <a href="http://www.politico.com/magazine/story/2016/10/the-very-political-james-comey-214403"><em>Politico</em></a> opined that a string of recent FBI actions “give the lie to Comey’s repeated insistence that the FBI is above politics, exposing that notion as both irrelevant—[…] and absurd[.]”</p>
<p>Shapiro and Leopold’s lawsuit seeks public disclosure of specified government records to make sense of the pivotal role of the FBI, as well as of other agencies, in perhaps the most controversial presidential election in modern U.S. history.</p>
<p><span style="font-family: gt-cinetype-mono;">3.)</span> Due to the urgency of the matter, Leopold and Shapiro requested expedited processing of their FOIA request. The FBI failed to respond. This is a violation of the Freedom of Information Act.</p>
<p><span style="font-family: gt-cinetype-mono;">4.) </span>Not including this new lawsuit, Shapiro and Leopold already have two FOIA lawsuits against the FBI federal agencies for records on investigations involving Donald Trump.</p>
<p>In the <a href="https://news.vice.com/article/secret-service-added-lawsuit-seeking-records-on-donald-trump">first</a> of these lawsuits, among other things, Shapiro and Leopold are suing the FBI and Secret Service for records on Donald Trump’s thinly-veiled assassination remarks regarding Hillary Clinton, and his less than veiled campaign trail call for Russian hacking of Hillary Clinton’s emails. The FBI unlawfully failed to respond to Shapiro and Leopold’s FOIA request, and then slow-walked an initial response to Shapiro and Leopold’s lawsuit until after the election.</p>
<p>Notably, the FBI’s response indicates the FBI <a href="https://news.vice.com/story/fbi-may-have-been-investigating-trump-when-comey-announced-new-clinton-emails">might indeed be investigating Donald Trump</a> for these incidents. However, in stark contrast to Director Comey’s pre-election rush to inform Congress that the FBI might re-open its investigation of Hillary Clinton, in this case the FBI dragged its feet to avoid revealing the same about Donald Trump until after the election.</p>
<p><span style="font-family: gt-cinetype-mono;">5.)</span> In the <a href="https://www.muckrock.com/news/archives/2016/nov/15/foiaing-trump-presidential-transition/">second</a> of these lawsuits, Leopold and Shapiro are suing the FBI for all FBI records on the Trump Organization, the Trump Foundation, Trump Entertainment Resorts, and Trump University.</p>
<p><span style="font-family: gt-cinetype-mono;">6.) </span>Shapiro and Leopold’s lawsuit filed today is part of the work of <a href="https://www.gofundme.com/operation-45">Operation 45</a>. Operation 45 is a new 501(c)(3) charitable organization <a href="http://www.salon.com/2016/11/27/foia-superhero-launches-campaign-to-make-donald-trumps-administration-transparent/">founded</a> by MIT/Harvard’s Shapiro, and attorney Jeffrey Light, to ensure transparency and accountability for the incoming Trump/Pence administration.</p>

										<content:encoded><![CDATA[<p class="hang-2-column"><strong>CAMBRIDGE, MA —</strong> As revealed in an <strong><a href="http://america.aljazeera.com/articles/2014/7/10/mandela-documentscommunistthreat.html">exclusive report</a></strong> by Jason Leopold for <em>Al Jazeera America</em>, Massachusetts Institute of Technology (MIT) PhD candidate Ryan Shapiro has received a second batch of documents from the FBI as part of Shapiro’s Freedom of Information Act (FOIA) lawsuit for records on Nelson Mandela.  In the wake of recent NSA and FBI spying revelations, the documents obtained by Shapiro shed light on decades of politically motivated FBI surveillance, including the monitoring of Mandela&#8217;s post-prison meeting with a Yugoslavian President and the surveillance of Mandela&#8217;s meetings with activists in the USA.</p>
<p class="hang-2-column">The first batch of documents, received by Shapiro last month, <a href="http://america.aljazeera.com/articles/2014/5/28/fbi-spied-mandeladocuments.html">exposed</a> FBI spying on Mandela during his historic 1990 visit to the U.S. shortly after his release from 27 years in prison for anti-apartheid activities.</p>
<p class="hang-2-column">The newly released second batch of documents provides additional evidence of FBI monitoring and surveillance of Mandela’s activities, both prior to and following his release from prison. This included FBI monitoring of Mandela’s meetings with world leaders.</p>
<p class="hang-2-column">Further, the newly released documents also reveal FBI investigation of the South African and U.S. anti-apartheid movements as being Communist threats to American domestic security. Notably, these FBI “Communist” threat investigations of the anti-apartheid movement continued even after U.S. imposition of trade sanctions against apartheid South Africa, after Mandela’s release from prison, and after the fall of the Berlin wall.</p>
<p class="hang-2-column">Shapiro, <a href="https://www.muckrock.com/news/archives/2013/dec/20/requesters-voice-ryan-shapiro-street-fighting-fbi-/">a FOIA specialist</a>, is an historian of the political functioning of national security and the policing of dissent. His pathbreaking FOIA work has already led the FBI to declare his MIT dissertation research <a href="http://www.motherjones.com/politics/2013/11/foia-ryan-shapiro-fbi-files-lawsuit">a threat to national security</a>. <p class="hang-2-column"><strong>Six key takeaways from the FBI’s latest release of documents to Shapiro:</strong></p>
<p class="hang-2-column"><strong>1. The FBI monitored Mandela’s meetings with a foreign world leader and spied on his meetings with domestic U.S. dissidents.</strong></p>
<p class="hang-2-column">In the <a href="http://www.sparrowmedia.net/2014/05/fbi-releases-nelson-mandela-documents-response-mit-students-foia-lawsuit/">first release</a> of documents to Shapiro, we learned that although the FBI assisted in protecting Mandela on his 1990 U.S. visit, the Bureau also took that opportunity to spy upon the newly freed iconic anti-apartheid leader. Those documents revealed the FBI developed a confidential informant within or closely affiliated with Mandela’s U.S. entourage, and this informant provided the FBI not only with logistical information about Mandela, but also political information about Mandela and his associates.</p>
<p class="hang-2-column">The newly released second set of documents reveal further politically-motivated FBI monitoring and surveillance of Mandela upon his release from prison, including the monitoring of a meeting between Nelson Mandela and a foreign world leader. For example, in a newly released March 1990 document that is still largely classified “Secret,” the FBI is shown to have <a href="http://issuu.com/sparrow/docs/mandela_1"><strong>monitored</strong></a>[.pdf ] a meeting in Namibia between Mandela and Janez Drnovsek, then president of Yugoslavia and leader of the Non-Aligned Countries. The Non-Aligned Countries Movement was deeply supportive of Mandela and his anti-apartheid political party, the African National Congress (ANC).</p>
<p class="hang-2-column">Another newly released document, this one a heavily redacted June 1990 internal FBI communication, shows the FBI authorized a Philadelphia FBI agent or a Philadelphia FBI confidential informant to travel to New York City to <a href="http://issuu.com/sparrow/docs/mandela_2"><strong>surveil</strong></a> [.pdf ] a potential meeting between Nelson Mandela and members of the Puerto Rican nationalist movement. After concluding there was “at least a possibility of a personal meeting with Mandela” and the Puerto Rican activists, both the New York City and Philadelphia FBI field offices considered surveillance of this potential meeting to be a “necessity[.]”</p>
<p class="hang-2-column"><strong>2. The FBI monitored Mandela even before his release from prison. </strong></p>
<p class="hang-2-column">Several of the newly released documents reveal FBI <a href="http://issuu.com/sparrow/docs/mandela_3"><strong>monitoring</strong></a> [.pdf ] of foreign and U.S. newspapers for information on Mandela while Mandela was still incarcerated. For example, two formerly classified “Secret” July 1989 documents show FBI language specialists clipped, and when necessary, translated press articles discussing a possible early release from prison for Mandela. The FBI’s language specialists then forwarded this information to FBI Counterintelligence supervisors. (For more on FBI Counterintelligence programs, see #3 below.)</p>
<p class="hang-2-column"><strong>3. The FBI investigated the South African and U.S. movements to end apartheid and free Nelson Mandela as Communist plots.</strong></p>
<p class="hang-2-column">The newly released documents reveal that, just as it did in the 1950s and 1960s with <a href="http://www.motherjones.com/politics/2013/08/j-edgar-hoover-war-martin-luther-king">Martin Luther King</a> and the <a href="http://dissenter.firedoglake.com/2014/01/20/martin-luther-king-jr-cointelpro-the-normalization-of-bulk-surveillance-in-post-911-america/">civil rights movement</a>, the FBI aggressively investigated the U.S. and South African anti-apartheid movements as Communist plots. In one newly released still partially classified “Secret” July 1984 FBI internal teletype, the FBI <strong><a href="http://issuu.com/sparrow/docs/mandela_4">highlighted</a></strong> [.pdf ] the purported communist associations of some supporters of African American U.S. Congressman George Crockett’s (D-MI) then-pending House resolution calling for “Freedom for Nelson and Winnie Mandela.” Another document, a newly released formerly classified “Secret” January 1985 record, shows the FBI viewed a <strong><a href="http://issuu.com/sparrow/docs/mandela_5">newspaper petition</a> </strong>[.pdf ] calling upon President Reagan to condemn Mandela’s continued incarceration as evidence of Communist Party USA (CPUSA) subversive activities. And a newly released August 1990 formerly classified “Secret” FBI internal communication reveals the FBI’s <strong><a href="http://issuu.com/sparrow/docs/mandela_6___7">insistence</a> </strong>[.pdf ] that support for a joint 1990 House resolution calling for establishment of a “Nelson Mandela/ANC Day” was Communist-inspired. In the document, the FBI is further shown to have insisted that the congressman who introduced the joint resolution, civil rights icon Charles Hayes (D-IL), was himself “a former member of CPUSA.”</p>
<p class="hang-2-column"><strong>4. The FBI understood these anti-Apartheid purported communist plots to be threats to American national security. </strong></p>
<p class="hang-2-column">Not only did the FBI explicitly investigate the South African and U.S. anti-apartheid movements as communist plots, the FBI viewed these plots as menacing American national security. This is evident in the investigation classification codes utilized by the FBI in the newly released documents. As can be seen again and again in the newly released documents, the two FBI investigation classification codes most commonly associated with the FBI’s “Communist” investigations of the anti-apartheid movement were “100” and “229.”</p>
<p class="hang-2-column">The 100 classification signifies an FBI “<a href="http://www.fbi.gov/foia/privacy-act/63-fr-8659">Domestic Security</a>” investigation. Not only do FBI “Domestic Security” investigations definitionally pertain to FBI investigations of perceived security threats, the 100 classification was the primary classification used by the FBI during its notorious and ultimately deemed to be unconstitutional COINTELPRO campaigns (see below) against the U.S. civil rights, free speech, and anti-Vietnam War movements, among others.</p>
<p class="hang-2-column">The 229 investigation classification signifies an FBI “<a href="http://www.fbi.gov/foia/privacy-act/63-fr-8659">Foreign Counterintelligence Matters</a>” investigation. Several of the newly released documents also bear the “G-3” security code classification, which also <a href="https://www.thetorturedatabase.org/files/foia_subsite/pdfs/DOJFBI002348.pdf">signifies</a> a Foreign Counterintelligence Investigation. Traditionally, counterintelligence entails the prevention of espionage, however the FBI has historically used term to mean spying on and disrupting political dissidents. The most obvious example is the FBI’s infamous <a href="http://www.democracynow.org/topics/cointelpro">COINTELPRO</a>, or COunter INTELigence PROgram, in which the FBI unlawfully surveilled, infiltrated, and at times violently disrupted anti-war, civil rights, and other American political dissident movements. COINTELPRO targets included Martin Luther King, the National Association for the Advancement of Colored People (NAACP), Muhammed Ali, Students for a Democratic Society (SDS), and the National Lawyers Guild.</p>
<p class="hang-2-column"><strong>5. The FBI’s understanding of the anti-apartheid movement was so warped, one FBI field office felt compelled to internally refute the FBI’s distorted facts and analysis on the subject.</strong></p>
<p class="hang-2-column">An especially illuminative August 1990 formerly classified “Secret” internal FBI <a href="http://issuu.com/sparrow/docs/mandela_6___7"><strong>teletype</strong></a> [.pdf ] from the FBI’s Chicago field office takes the Bureau’s official understanding of the ANCand the broader anti-apartheid movement unsparingly to task. In response to an FBI memo earlier that month describing the ANC as a “known Soviet front group,” the FBI’s Chicago field office provided a stunning rebuke, noting the Bureau’s “description of the ANC as a Soviet Front is an over-simplification which fails to recognize the complex and paradoxical nature of that particular organization […] which was, of course, founded before the Russian Revolution.” Over the course of nine pages, the FBI’s Chicago field office continued an unflinching education of the Director of the FBI and numerous FBI field offices on the history, methods, and mission of the ANC. This included information on the ANC’s decades-long commitment to “non-violent activism” prior to the South African government’s banning of the ANC in 1960, the ANC’s consequent adoption of “symbolic” sabotage tactics, the South African government’s consequent “life imprisonment for sabotage” of ANC leaders including Nelson Mandela, and the fact that the ANC “turned to the Soviet Bloc for support only after failing to enlist the support of the U.S. and Western Europe in their struggle against apartheid and its attendant inequities.” The FBI’s Chicago field office further noted the South African apartheid system was characterized by “official racism” and enforced “obvious inequities[.]” Additionally, the Chicago field office admonished the broader Bureau that, “It is, at this point in time, clear that any lasting settlement of South Africa’s future will involve Nelson Mandela and the ANC.”</p>
<p class="hang-2-column"><strong>6. As with the previous release, the FBI has again withheld a huge amount of information, and the NSA, CIA, and DIA have yet to release any documents at all.</strong></p>
<p class="hang-2-column">Not only did the FBI withhold some pages in their entirety from this release, many of the records the FBI did release are heavily redacted. One such document, a still largely classified “Secret” 1993 NY FBI foreign counterintelligence memo pertaining to Mandela, involved a confidential informant who explicitly <strong>“<a href="http://issuu.com/sparrow/docs/mandela_8">provided [the FBI] political information[.]</a>”</strong> [.pdf ]  Additionally, The FBI justified its redactions and withholdings in this release in part by invoking FOIA exemptions pertaining to national security, the use of confidential informants, and perhaps most bizarrely, ongoing investigations.</p>
<p class="hang-2-column">Further, while the FBI’s latest document release is definitely problematic, the NSA, CIA, and DIA have yet to release any documents at all regarding Mandela in response to Shapiro’s FOIA requests and lawsuit. And these are the agencies most likely to posses records pertaining to U.S. intelligence community involvement in pro-apartheid South African affairs prior to Mandela’s 1990 release from prison. U.S. involvement in these affairs, including the <a href="http://articles.chicagotribune.com/1990-06-10/news/9002170271_1_anti-apartheid-activities-gerard-ludi-cia-spokesman-mark-mansfield">likely involvement of the CIA in Mandela’s 1962 arrest</a>, and the confirmed <a href="http://www.nytimes.com/1986/10/13/opinion/a-loophole-in-us-sanctions-against-pretoria.html?smid=tw-share">provision by the NSA of intelligence to the apartheid regime into the 1980s</a>, are deeply shameful.</p>
<p class="hang-2-column">According to Shapiro:</p>
<p class="hang-2-column">“The newly released documents not only bring to light additional politically motivated FBI spying on Mandela, they also expose something even darker. The documents reveal that, just as it did in the 1950s and 60s with Martin Luther King and the civil rights movement, the FBI aggressively investigated the U.S. and South African anti-apartheid movements as Communist plots imperiling American security. Worse still, the documents demonstrate the FBI continued its wrong-headed Communist menace investigations of Mandela and the anti-apartheid movement even after U.S. imposition of trade sanctions against apartheid South Africa, after Mandela’s globally-celebrated release from prison, and after the fall of the Berlin Wall. Ultimately, what the documents reveal is the FBI’s unflagging conflation of social justice efforts with security threats, and the FBI’s cartoonish obsession with Communist Party subversion in the United States even as the Cold War itself crumbled into obsolescence.”</p>

										<content:encoded><![CDATA[<p class="hang-2-column"><strong>WASHINGTON, DC —</strong> Investigative journalist Jason Leopold and Massachusetts Institute of Technology (MIT) PhD candidate Ryan Shapiro filed a lawsuit this morning against the Central Intelligence Agency. The suit is over the CIA’s failure to comply with Leopold and Shapiro’s Freedom of Information Act (FOIA) request for records on the CIA’s alleged spying on the Senate Select Committee on Intelligence’s (SSCI) review of the CIA’s notorious rendition, detention and interrogation (RDI) program.</p>
<p class="hang-2-column">As detailed in an <a href="https://news.vice.com/article/exclusive-cia-sued-for-info-over-spying-on-senate-torture-investigation"><strong>exclusive report</strong></a> by Natasha Lennard for <em>Vice News</em>, through their FOIA request and lawsuit, Leopold and Shapiro seek to shed light on a critical yet little-understood ongoing controversy frequently described as a possible constitutional crisis.</p>
<p class="hang-2-column">Jason Leopold is an investigative journalist covering counterterrorism and human rights. He has been called a &#8220;FOIA Terrorist&#8221; by federal employees for his aggressive use of the Freedom of Information Act, which includes successfully <a href="http://truth-out.org/news/item/10400-a-victory-in-my-foia-lawsuit-against-the-fbi">suing</a> the FBI to force changes to Bureau FOIA practices.</p>
<p class="hang-2-column">Ryan Shapiro, <a href="https://www.muckrock.com/news/archives/2013/dec/20/requesters-voice-ryan-shapiro-street-fighting-fbi-/">a FOIA specialist</a>, is an historian of the political functioning of national security and the policing of dissent. Shapiro’s pathbreaking FOIA work has already led the FBI to declare his MIT dissertation research <a href="http://www.motherjones.com/politics/2013/11/foia-ryan-shapiro-fbi-files-lawsuit">a threat to national security</a>.</p>
<p class="hang-2-column">Leopold and Shapiro are represented by Washington, DC-based FOIA specialist attorney Jeffrey Light.</p>
<p class="hang-2-column"><strong>Three key elements of Shapiro and Leopold’s FOIA request and lawsuit:</strong></p>
<p class="hang-2-column"><strong>1.</strong> The records at issue pertain directly to a possible ongoing constitutional crisis:</p>
<p class="hang-2-column">As editorialized by a leading newspaper <a href="http://www.star-telegram.com/2014/03/12/5644148/cia-vs-senate-is-a-real-mess-maybe.html?rh=1">opining</a> on the matter, “Government spying from Washington has become government spying on Washington and may have escalated into a full constitutional crisis.”</p>
<p class="hang-2-column">Along these lines, SSCI Chairwoman Senator Dianne Feinstein (D-CA) herself flatly <a href="http://www.feinstein.senate.gov/public/index.cfm/press-releases?ID=db84e844-01bb-4eb6-b318-31486374a895">accused</a> the CIA of obstructing and surveilling her Senate committee’s review of the CIA’s RDI program. Highlighting the “grave implications of Executive Branch personnel interfering with an official congressional investigation[,]” Senator Feinstein declared the CIA’s actions “may well have violated the separation of powers principles embodied in the United States Constitution, including the Speech and Debate clause. It may have undermined the constitutional framework essential to effective congressional oversight of intelligence activities or any other government function.” Feinstein continued that the CIA’s actions, “may also have violated the Fourth Amendment, the Computer Fraud and Abuse Act, as well as Executive Order 12333, which prohibits the CIA from conducting domestic searches or surveillance.” Feinstein concluded by remarking that the outcome of this affair will determine whether the Senate “can be effective in monitoring and investigating our nation’s intelligence activities, or whether our work can be thwarted by those we oversee.”</p>
<p class="hang-2-column">In like fashion, Senator Lindsey Graham (R-SC) <a href="http://www.star-telegram.com/2014/03/12/5644148/cia-vs-senate-is-a-real-mess-maybe.html?rh=1">characterized</a> the CIA’s actions as “Richard Nixon stuff” “dangerous to the democracy” and that “heads should roll, people should go to jail if it’s true.”</p>
<p class="hang-2-column"><strong>2.</strong> The public war of words between the Senate and the CIA, as well as the continuing inability of the American people to know the truth about confirmed CIA torture and alleged CIA spying on its Congressional overseers, led Leopold and Shapiro to file a wide-ranging Freedom of Information Act request to the CIA seeking:</p>
<p class="hang-2-column" style="padding-left: 30px;">a) A copy of all written agreements and correspondence between the SSCI (including Senators on the committee, their staff, and committee staff) and the CIA (or its agents, including contractors) which set forth the terms under which SSCI staffers would be permitted to access CIA documents at the secure CIA facility in Virginia.</p>
<p class="hang-2-column" style="padding-left: 30px;">b) A copy of all records documenting any CIA investigation into the search of SSCI’s computers at the secure facility in Virginia, including any records generated by the CIA’s Inspector General in the course of any investigation; records referring the incident(s) to the Department of Justice for investigation; and correspondence between the SSCI (including Senators on the committee, their staff, and committee staff) and the CIA (or its agents, including contractors) which discuss the event.</p>
<p class="hang-2-column" style="padding-left: 30px;">c) A copy of all records documenting any CIA investigation into the removal of the Panetta Review, including any records generated by the CIA’s Inspector General in the course of any investigation; records referring the incident(s) to the Department of Justice for investigation; and correspondence between the SSCI (including Senators on the committee, their staff, and committee staff) and the CIA (or its agents, including contractors) which discuss the event.</p>
<p class="hang-2-column" style="padding-left: 30px;">d) For any CIA contractor responsible for reviewing records relating to the CIA’s former Detention and Interrogation Program before access was provided to SSCI staff, a copy of the contract, the request for proposal, proposal, bid solicitation, and bid.</p>
<p class="hang-2-column" style="padding-left: 30px;">e) A copy of any and all talking points (in draft and final form) and any and all guidance issued to the CIA’s Office of Public Affairs about the ongoing dispute between the Central Intelligence Agency (CIA) and the Senate Select Committee on Intelligence (SSCI) over the SSCI’s review of the CIA’s former Detention and Interrogation Program.</p>
<p class="hang-2-column"><strong>3.</strong> The CIA has failed to comply with Leopold and Shapiro’s FOIA request and is now in violation of the Freedom of Information Act. Consequently, Leopold and Shapiro have filed a lawsuit to compel CIA compliance with their FOIA request for records on this affair.</p>
<p class="hang-2-column"><strong>According to Shapiro:</strong></p>
<p class="hang-2-column">“The U.S. intelligence community is notorious for its profound hostility to transparency. In the present case, the CIA appears to have spied upon the very Senate intelligence committee tasked with overseeing the CIA’s torture program, while at the same time smearing that Senate committee’s review with unsupported allegations of criminality. Now, the CIA is further flouting transparency by refusing to comply with our FOIA request for records on this troubling affair. The democratic process cannot meaningfully function without an informed citizenry, and such a citizenry is impossible without broad public access to information about the operations of government. It’s time for the CIA and the rest of the U.S. intelligence community to recognize transparency not as a threat, but rather as an essential component of viable democracy.”</p>
