Washington, DC — Over the past year, Freedom of Information Act (FOIA) requests and litigation filed by the transparency organization Property of The People (PoTP) has produced receipts and other documents revealing an excess of $344,008.28 in emoluments from US government agencies at Trump properties. Property of the People is publishing these documents in their entirety today in their new searchable archive. A full list of document urls is attached below in our note to editors.

Via a partnership with our colleagues at ProPublica, these documents, in addition to others, have been integrated into an evergreen interactive news application for journalists, activists, and researchers to track how Donald Trump and his family trust are profiting off the US Presidency. Titled “Paying the President” this news app highlights $16.1 million in campaign and agency payments made to Trump properties since the 2015 announcement Trump’s campaign, including $386,474.66 of taxpayer money. Federal taxpayer data will be regularly updated and remains incomplete because agencies are fighting disclosure.

PoTP’s newest documents show expenses of $79,618.25 spent at Trump properties by the State Department, and $3,768.94 spent at Trump properties by the Department of Commerce since President Trump took office.

To date FOIA litigation from PoTP has uncovered the following agency payments at Trump properties:

$147, 379.50 in Department of Defense expenditures at Trump Properties from January to June, 2017;

$108,876.55 in Department of Homeland Security expenditures at Trump Properties across three events in January 2017, May 2017, and February 2018;

$79,618.25 in Department of State expenditures at Trump Properties since February 2017;

$3,768.94 in Department of Commerce expenditures at Trump Properties since January 2017;

$2,604.57 in Coast Guard expenditures at Trump Properties from February to June 2017;

and $1,760.46 in General Services Administration expenditures at Trump Properties from February to June 2017.

The State Department and Department of Commerce documents uncovered build upon earlier discoveries by PoTP, and show that it is both standard practice for Donald Trump to charge government employees the maximum posted rate (also known as the “rack rate”) for stays at Mar-A-Lago. Property of the People co-founder Sarahjane Blum explains, “setting up a situation where the American public is forced to pay the exorbitantly high rack to get the work of governing done is one of the many ways the Trump presidency is setting up and normalizing kleptocracy.”

Sarahjane Blum explains these emoluments on WNYC’s Trump Inc,

“Donald Trump views the American public as a bunch of marks waiting to be fleeced,” said Property of the People co-founder, Ryan Shapiro.“Due to his refusal to divest from his sprawling business empire, Donald Trump has turned the American Presidency into a racket.”

Added Property of the People staff attorney, Gunita Singh, “Repeatedly, our FOIA litigation has revealed blatant financial conflicts of interest resulting in the transfer of taxpayer dollars to Trump properties and likely constitutional violations. We expect this is only the tip of the iceberg, and we fully intend to aggressively continue our FOIA work exposing kleptocracy at the highest reaches of government.”

In September 2017, documents obtained by Property of the People from the Coast Guard and DHS revealed National Security Council and other agency payments to Mar-A-Lago and Trump Hotels.
A Note to Editors

Property of the People has organized these government charge card documents and others together as part of their Operation 45 project. The projects full archive can be browsed online HERE. For journalists and editors who would like URLs for individual documents we have organized them by agency below.

Washington, DC — A Freedom of Information Act (FOIA) lawsuit from the transparency organization Property of The People has produced receipts and other documents revealing Department of Defense (DoD) expenditures at Mar-a-Lago and twelve Trump properties during the President’s first six months in office. The expenses, each made with DoD charge cards, raise serious questions as to whether Donald Trump is violating the Domestic Emoluments Clause of the United States Constitution.

Among the documents released today is an 8-page summary chart provided by the Department of Defense outlining the majority of $138,093.23 in DoD charges at Trump properties beginning on the first day of the administration, January 20, 2017, through June 14, 2017. The release also includes a 369-page document with receipts corresponding to a selection of the charges outlined in the summary chart. Among the charges were $58,875.69 in charges incurred specifically at Mar-a-Lago; $9,618.78 at Trump’s Bedminster, NJ Golf Club during an extended weekend stay in May, 2017; $35,652.44 spent at Trump’s Las Vegas Hotel; and $17,102.55 in DoD expenditures at Donald Trump’s beleaguered Trump Ocean Club in Panama.

The FOIA lawsuit that obtained the receipts was brought by Property of the People and the organization’s co-founder, MIT FOIA researcher Ryan Shapiro. The group and Shapiro have filed similar FOIA requests with The US State Department, Department of Commerce, General Services Administration, US Coast Guard, Department of Homeland Security, Secret Service, and US Customs and Border Protection.

In September 2017, documents obtained by Property of the People from the Coast Guard and DHS revealed National Security Council and other agency payments to Mar-A-Lago and Trump Hotels. These documents provided the first strong evidence of Trump’s violation of the Domestic Emoluments Clause. These revelations also informed Senators Gary Peters, Elizabeth Warren, and Tom Udall’s decision to introduce the HOTEL Act — Heightened Oversight of Travel, Eating and Lodging — banning executive officials from staying at any property owned by the president, vice president, Cabinet secretaries or their families members.

And last month, documents released by the General Services Administration (GSA) to Property of the People highlighted $1,760.46 in charges made by the GSA across three days in 2017 at the Trump International Hotel in DC and the BLT Prime Restaurant located within the DC Trump Hotel.

“Donald Trump views the American public as a bunch of marks waiting to be fleeced,” said Property of the People co-founder, Ryan Shapiro. “With the DoD’s spending at Mar-a-Lago and other Trump properties, and Trump’s refusal to divest from his sprawling business empire, once again we find the President’s hand deep in the taxpayer’s pocket.”

Continued Shapiro, “Trump’s venality and his administration’s open contempt for transparency creates a functionally unprecedented potential for conflicts of interest and corruption.”

As part of the the organization’s efforts to seek transparency and accountability from the Trump administration, Property of the People has thousands of FOIA requests in motion with numerous federal agencies, as well as numerous active federal FOIA lawsuits to compel agency compliance with the organization’s requests.

In September 2017, documents obtained by Property of the People from the Coast Guard and DHS revealed National Security Council and other agency payments to Mar-A-Lago and Trump Hotels. —

Washington, DC — On Monday, December 11, 2017, Property of the People mailed a letter to the General Services Administration’s Committee Management Secretariat asking that Christy McCormick be terminated from the President’s Advisory Committee on Election Integrity.

52 U.S.C. § 20923(d)(2), which governs the U.S. Election Assistance Commission, explicitly states that “[n]o member appointed to the Commission under subsection (a) may engage in any other business, vocation, or employment while serving as a member of the Commission and shall terminate or liquidate such business, vocation, or employment before sitting as a member of the Commission.”

Christy McCormick serves on the Election Assistance Commission (EAC). McCormick was also appointed to serve on the President’s Advisory Committee on Election Integrity (PACEI).

McCormick’s dual positions matter not only because they violate the letter of the law, but also the spirit.

The EAC is an independent agency. When Congress creates independent agencies, it is with the intention that their officers discharge their duties independently of presidential control. Influence from the executive, whether direct or indirect, must not enter the calculus of the officer’s decision-making. This concept dates back to the very founding of our nation. McCormick’s service on the PACEI, a commission created by President Donald Trump, himself, threatens to blight McCormick’s service on the nonpartisan, independent EAC.

Sarahjane Blum, Property of the People Chair states: “we are in a moment where confidence in the American electoral system is profoundly low. Preserving the credibility of the bodies tasked with overseeing voting policy is critical for future elections, and as such, Christy McCormick cannot be allowed to hold dual positions at the EAC and PACEI.

The only way to resolve this circumvention of federal law is for Commissioner McCormick to resign from the PACEI.
In a move roundly criticized by journalists and transparency groups, on April 14th, 2017, the Trump administration announced it was abandoning the Obama-era policy of making White House visitor logs open for public inspection. Seeking to restore public access to these crucial records, the Washington, D.C.-based transparency organization Property of the People filed Freedom of Information Act (FOIA) requests with numerous White House offices, and filed suit against some of these offices for failure to comply with the group’s requests.

As a result, Property of the People obtained large portions of these White House visitor logs and calendars. In a publishing and development partnership with ProPublica, a searchable database containing 8,807 entries from these White House visitor logs and calendars was created for journalists and concerned citizens. The release contains entries spanning January 20, 2017 to September 6, 2017, which represent a large portion of the meetings taken by the White House’s executive Office of Management and Budget (OMB), Council on Environmental Quality (CEQ), Office of National Drug Control Policy (ONDCP), Office of Science and Technology Policy (OSTP), and the Office of the United States Trade Representative (USTR).

Within these records are revelations both small and large. Today ProPublica leads with reporting based on the released documents that upon arrival at OMB director Mick Mulvaney’s calendar quickly became a who’s who black book of corporate and conservative interests — a selection includes casino magnate and friend of the president, Steve Wynn; representatives of the ultra-conservative Heritage Foundation; Wall Street and health CEOs; Koch Industries lobbyists; a Russian cryptocurrency evangelist; and a prominent member of the right wing Catholic organization Opus Dei.

Of their joint effort with ProPublica, Property of the People co-founder Ryan Shapiro says, “The ProPublica reporting based on our documents unmistakably reveals that OMB maintains an open door policy for those representing many of the most conservative interests in the country. Imagine what we might learn if the White House stopped hiding and actually made its full logs available. The democratic process cannot meaningfully function without an informed citizenry, and such a citizenry is impossible without broad public access to information about the operations of government. Trump’s secrecy surrounding White House visitor logs denies the public information it needs to hold this administration accountable.”

Property of the People Chair Sarahjane Blum adds, “obtaining these documents is an important step towards transparency, but the White House is still improperly withholding many names from these logs. Property of the People continues to vigorously seek release of these names through our ongoing FOIA litigation.”

Moving forward, new White House visitor logs and calendar entries will be added to the database as they are obtained by Property of the People via the organization’s continuing Freedom of Information Act requests and lawsuits.

After licensing his name to the Trump Ocean Club in 2006, Trump appears to have turned a blind eye to the source of the buyers’ funds and the background of some of the individual brokers (1). The investigation, Narco-a-Lago: Money Laundering at the Trump Ocean Club, Panama provides powerful evidence that profits from Colombian cartels’ narcotics trafficking were laundered through the Trump Ocean Club. Trump was one of the beneficiaries, since he received a cut of all sales. Trump’s Presidential disclosures show he was still making money from a management contract for the Trump Ocean Club when he took office in 2017.

“This must be investigated. Donald Trump has made millions from a project used by Latin American drug cartels to launder money. The warning signs were there for a responsible businessperson, but it seems Trump didn’t want to know,” said Eryn Schornick, Senior Policy Advisor at Global Witness.

The Trump Ocean Club in Panama was one of Trump’s most lucrative licensing deals: initial projections indicate that he was set to make $75.4 million by 2010. Sources close to the development described it as “Ivanka’s baby”, and confirmed that Trump’s daughter was in overall charge of the licensing venture for the Trump Organization.

The report highlights several warning signs for money laundering in the project, which should have raised the alarm for a responsible businessperson looking to avoid being associated with dirty money. Panama was a major hub for money laundering when Trump signed the licensing and management deal with the Trump Ocean Club in 2006. Global Witness’ sources indicate that many units were bought in bulk, some sales were made with bearer shares, and secretly owned companies were often used, hiding the identities of the buyers.

The investigation also shines a light on several dubious characters that bought units or brokered transactions at the Trump Ocean Club. Those involved include:

David Murcia Guzmán, released from U.S. federal prison after serving a sentence of nine years for laundering millions of dollars’ worth of illicit funds, including narcotics proceeds, through secret companies and real estate.

Murcia Guzmán’s business associate Alexandre Ventura Nogueira, who claims to have brokered nearly a third of all 666 pre-construction unit sales at the Trump Ocean Club. Ventura Nogueira, who has faced accusations of criminal activity including fraud, was critical to ensuring the project’s lift-off and hence Trump’s ability to earn tens of millions of dollars.

Ventura Nogueira assembled a team of agents and brokers to market Trump Ocean Club units, often targeting buyers of Russian and Eastern European origin. Some of these agents have faced serious accusations of criminal activity.

Although the extent of Trump’s knowledge of these brokers and buyers is unknown, it is highly likely that the Trump Organization had the right to receive sales reports and demand information on the buyers. Buying high-end real estate through secretly-owned companies is a well-known way for criminals to stash the cash they make through crime and launder it to spend without scrutiny. It’s a tried and trusted method used by organized crime, drug cartels and human traffickers.

“Now that Donald Trump is president, his business is the nation’s business. He claims to be tough on crime and drugs, yet he’s earned millions from selling his name to a Panama development used to launder drug money,” said Schornick. “These fresh revelations of unscrupulous business dealings show his public rhetoric is both misleading and hypocritical.”

Washington, DC — Leaked documents published today by the International Consortium of Investigative Journalists expose how offshore tax havens, white-collar professionals, and anonymous company owners hide their finances behind a veil of secrecy. The documents from Bermuda-based law firm Appleby include evidence of dubious deals and holdings involving the Queen of England, Canadian Prime Minister Justin Trudeau’s chief fundraiser, and Trump appointed U.S. Commerce Secretary Wilbur Ross.

According to the documents, Wilbur Ross used a constellation of companies, some with their ownership undisclosed. The companies were set up by Appleby to retain shares in Navigator Holdings, a shipping firm with business ties to a Russian oligarch subject to American sanctions.

Ross’ stake has received more than $68 million in revenue since 2014 from Sibur, a Russian energy company co-owned by the son-in-law of Russian President Vladimir Putin. The documents also report that Appleby has administered some 50 companies and partnerships set up in the Caymans and other tax havens that are connected to Ross, whose net worth is estimated to be more than $2 billion dollars.

“This is yet another instance of conflicts of interest within the Trump administration. Wilbur Ross influences US trade and sanctions, yet he is still making millions from a Russian company that could be targeted by these decisions. This is highly problematic for an administration at the center of investigations into collusion with the Russian state,” said Mark Hays, Anti Money Laundering Campaign Leader at Global Witness.

The White House National Security Council (NSC) paid over $1,000 for an unidentified guest to stay two nights at Donald Trump’s luxury resort Mar-a-Lago, according to an invoice obtained by transparency group Property of the People via a Freedom of Information Act (FOIA) request. This payment, made with a U.S. government charge card, constitutes the first documented violation by President Trump of the Constitution’s Domestic Emoluments Clause. President Trump owns 99.99% of Mar-a-Lago, LLC directly, and the company’s profits are held in a revocable trust from which Trump may withdraw funds without restriction.

This and related documents were recently obtained via a FOIA request submitted by Property of the People as part of the organization’s Trump administration-specific transparency project, Operation 45.

The NSC invoice is the strongest evidence uncovered to date that Trump’s refusal to divest from his business empire has resulted in Trump’s violation of the Constitution’s anti-corruption Domestic Emoluments Clause. This provision prohibits the President from receiving emoluments (profitable payments, benefits, or advantages) paid by federal or state governments, beyond the salary approved by Congress.

In the past, presidents possessing significant business holdings have divested themselves of their holdings or placed them into a blind trust prior to assuming office. President Trump, however, has adamantly refused to do either. Instead, Trump has placed his business empire into a revocable trust administered by his sons, a move that has been widely viewed by experts as insufficient. This trust is set up to allow Trump to withdraw any amount of money at any time for any reason “at his request.”

The released documents show that Mar-A-Lago charged the NSC full price for the rented room instead of offering the NSC a discounted rate covering only the resort’s costs. The NSC receipt lists the rate paid by the National Security Council as the “rack rate,” meaning the standard, non-discounted rate for the room. As such, the NSC’s payment to Mar-A-Lago constitutes a direct, profitable payment from a U.S. government agency to a business personally owned by Donald Trump. This is strong evidence of a violation by President Trump of the Domestic Emoluments Clause of the U.S. Constitution.

Property of the People also obtained invoices showing payments by the United States Embassy to Trump’s hotel in Panama, and documentation of payments by unidentified federal employees to Trump’s Washington, D.C. and Las Vegas hotels. These payments were all made on official U.S. government charge cards. They were obtained through Property of the People’s FOIA request to the United States Coast Guard, which administers the charge card program for the Department of Homeland Security.

To date, discussion of the potential constitutional implications arising from Trump’s business holdings has focused primarily on the Foreign Emoluments Clause of the Constitution. Three lawsuits have now been filed against President Trump alleging violations of the Foreign Emoluments Clause, and legal scholars and cities across the country are already calling for Trump’s impeachment on grounds including Foreign Emoluments violations. Far less attention has paid to the Domestic Emoluments Clause. The documents just obtained by Property of the People are the first solid evidence uncovered of Trump’s violation of the Domestic Emoluments Clause.

According to Property of the People Director Ryan Shapiro:

“These documents represent perhaps the clearest evidence yet that President Trump has violated the Domestic Emoluments Clause of the U.S. Constitution. The likely constitutional violation here belongs in any forthcoming articles of impeachment. Due to his glaring refusal to divest from his sprawling business empire, the President has no one to blame but himself.”

Shapiro and Property of the People are also calling on the Department of Justice, which has jurisdiction over potential violations of the Domestic Emoluments Clause, to investigate. Says Shapiro:

“These invoices are strong evidence of a constitutional violation and they warrant a thorough investigation by the Department of Justice.”

The complete set of documents obtained by Property of the People show that:

The National Security Council paid $1,092 for a March 3-4, 2017 stay at President Trump’s luxury Palm Beach, FL golf resort, Mar-a-Lago.

The U.S. Embassy in Panama paid $632 for a March 23, 2017 stay at Donald Trump’s Trump International Hotel & Tower in Panama City.

The Coast Guard paid $186.17 for a June 11-14, 2017 stay at Donald Trump’s Trump International Hotel & Tower in Las Vegas.

The documents obtained by Property of the People also reveal the Coast Guard paid $62.40 for food or drink at the Trump International Hotel in Washington, DC on June 2, 2017.

The documents were obtained in response to a FOIA request submitted by Property of the People to the United States Coast Guard. Property of the People is also pursuing the release of charge card records from other federal agencies to which the organization has submitted similar requests. These agencies include the United States Secret Service, the Department of State, the Department of Commerce, Customs and Border Patrol, the General Services Administration, and the Department of Defense.

Tonight at 9pm EST President Trump announced his new Afghanistan strategy, Global Witness’ Stephen Carter highlights what is needed for a real change in direction:

“The United States is Afghanistan’s key partner and has real potential to help break the cycle of violence there. But its continued presence will change nothing unless the US and the Afghan government also tackle the root causes of instability. That means fighting the corruption that allows insurgents and strongmen to reap the benefits of the country’s resources, and maintain their grip on power. ‘Nation-building’ in that sense is vital to what President Trump called ‘principled realism’ – not separate from it.

“Corruption is at the heart of insecurity in Afghanistan. It deeply undermines the effectiveness of Afghan forces and the legitimacy of the Afghan government, and is a huge obstacle to any realistic path to stability. Despite successive American military and political leaders acknowledging this challenge, in practice they have rarely treated it as a priority: it is ironic that it is now seen as impossible. If President Trump wants to turn Afghanistan around, there needs to be a real change in the way the US and the Afghan government’s approach governance issues, putting them on a par with military concerns and using levers of support and influence much more effectively.

“The Afghan mining sector is one obvious place to start. It is the second largest source of funding for the Taliban and a major driver of corruption and conflict. Global Witness’ own research, for example, shows how competition over illegal mining in Badakhshan has undermined the stability of an entire province and made it a hotbed of the insurgency. Despite this, basic transparency measures have yet to be put into effect, the Mining Law is missing key safeguards against corruption and conflict, and the Afghan government has struggled to produce basic information on contracts and production. The US has done relatively little to press for stronger action, even though the sector is central to hopes of building up Afghanistan’s economy – and for its ability to fund their own security forces and secure their territory without endless expenditure of American lives and money.

“Under President Ghani and CEO Abdullah the Afghan government has shown itself willing to contemplate serious reforms and to agree anti-corruption benchmarks, even if implementation has so far been slow. America has a partner in Afghanistan, but they need to seize the chance to work with them, and push hard for serious action. The call for ‘real reforms’ is welcome, but it has been made before, and is lacking specifics. President Trump’s Afghan strategy will stand or fall on how well he turns those words into action.” said Carter.

Stand With Reality, a nonprofit, nonpartisan coalition of concerned individuals, is launching a campaign today to defend N.S.A. contractor Ms. Reality Leigh Winner against an overzealous prosecution by the U.S. Department of Justice.

Winner has been charged under the Espionage Act, a 100-year-old statute originally designed for spies and saboteurs, for allegedly giving a document vital to the public’s understanding of potential Russian interference in U.S. election systems to a news organization.

Stand With Reality believes the charge against Winner is grossly disproportionate to her alleged offense, and is designed to create a chilling effect on investigative journalism by dissuading sources from sharing information that is critical to the public interest. The group is dedicated to raising public awareness of Winner’s case, as well as the U.S. government’s persistent abuse of the Espionage Act to silence its critics and stifle journalism.

“The document Winner is alleged to have given The Intercept is vital for understanding how U.S. election systems are seriously vulnerable to hacking. It is absurd that the government is charging her under the draconian Espionage Act rather than helping states fix our country’s election security,” said Jeff Paterson, Courage to Resist project director and co-founder of Stand With Reality.

The organization aims to fully fund Winner’s legal defense team headed by attorney Titus Nichols, of the Augusta, Georgia law firm of Bell & Brigham. Stand with Reality launched a crowdfunding campaign today to cover both legal fees and public awareness efforts. “It is refreshing to know that so many people that Ms. Winner has never known have come together to offer their support and prayers for her,” notes Nichols. “Your pledge of additional support, for fees related to her case, is commendable,” he adds.

“The new Stand with Reality group means the world to me. Not only are they going to be raising money for my daughter’s legal defense, they’ll also be raising awareness. Reality won’t be forgotten, and she’ll have a whole organization behind her,” said Winner’s mother, Billie Winner-Davis, of Kingsville, Texas. The Winner Family will be closing their GoFundMe effort and directing supporters to the new Reality Winner Defense Fund hosted by Courage to Resist in collaboration with Stand with Reality. Meanwhile, the UK-based Courage Foundation is undertaking fundraising and support efforts on behalf of Winner throughout Europe.

First Look Media’s Press Freedom Defense Fund provided a grant of $50,000 which will act as a matching fund for the first $50,000 raised for this campaign between now and August 30th. First Look is the publisher of The Intercept, which published its story based on a document allegedly provided by Winner after receiving it anonymously. The Fund is committed to supporting legal fights where key principles of press freedom are at stake, including the defense of journalistic sources like Winner facing this Espionage Act charge.

Winner, 25, is an Air Force veteran and recipient of the Air Force Commendation Medal for those who have “distinguished themselves by meritorious achievement and service.” She is universally described by friends and family as a “patriot”.

She is currently being denied bail on the basis that she is a flight risk, despite assurances from her family, and their offer of their 20-acre Southern Texas ranch as collateral.

“We believe the prosecution is trying to demoralize Reality and her family by denying her bail,” said Rainey Reitman, open Internet advocate and co-founder of Stand with Reality. “They’re punishing her with months in jail, and denying her the opportunity to fully participate in her defense preparations, all before a jury hears the merits of the government’s case.”

Stand with Reality was founded by three individuals dedicated to open government, free expression, civil liberties, and the rule of law:
